Maryland Chapter 7 Bankruptcy Practice

Maryland Chapter 7 bankruptcy is a quick process to eliminate credit card and unsecured debt and can be a useful tool to get a fresh start. Chapter 7 bankruptcy, called the “liquidation chapter,” can be a very useful tool to allow you to have a financial restart and fresh start. The process typically lasts 4-6 months and can eliminate credit card debt, personal loan debt, and other kinds of debt. In Chapter 7, the Means Test must typically be met.

Maryland Chapter 11 Bankruptcy Practice

Chapter 11  bankruptcy is the most complex chapter of bankruptcy and can be used for any business entity, corporation, LLC, partnership, or individual with high amounts of debt to reorganize debt. Although Chapter 11 bankruptcy is typically used by businesses, it can also be used for small business owners or specific individuals. Chapter 11 allows the restructuring of debts so that they can be repaid over time. When filing Chapter 11 bankruptcy in Maryland, the business can remain active while repaying creditors.

Chapter 13 Bankruptcy Practice

Chapter 13 bankruptcy is another common type of bankruptcy for individuals and is a more powerful chapter than Chapter 7. Chapter 13 is a very helpful tool for catching up on mortgage arrears, paying tax debt, and potentially adjusting certain kinds of secured debt over a 3-5 year payment plan. Chapter 13 bankruptcy is also useful for individuals who have unprotected equity in a home, or other valuable assets that a Chapter 7 trustee may seize, sell and distribute the funds to creditors.

Maryland Confessed Judgements

In Maryland, a confessed judgment clause allows a creditor’s attorney to file an affidavit with the lawsuit and effectively confess, on behalf of the debtor, that the judgment is owed. If filed correctly, the Court can immediately enter judgment against a debtor. Having a judgment entered means that a creditor can begin to collect on the judgment by garnishing bank accounts, wages, and other collection methods.

Asset Protection Practice

It is never too early to plan for and protect assets through various legal methods with an eye toward protecting assets from future creditors, whether you are an individual or business owner. In Maryland, both state and federal laws restrict some assets from creditors. While other states allow the choice between state or federal asset exemptions, Maryland requires you to only utilize the state exemptions. Many people are shocked to realize how little is protected. For many adults, it can be prudent to convert non-exempt assets into exempt assets for greater protection. Steiner Law Group can assist you with determining the best ways to protect your Maryland assets and guard yourself against future liability.
